A Nepali Businessman bought a new house in Zambia, an African country, which was in additional to a house he got in Kathmandu. After few years he died. His father, wife, a son and a daughter survived him. As a result, the question of inheritance of these properties arose in the Supreme Court of Nepal. The Nepali Muluki Civil Code Act, 2018 hold that the inheritance goes to the surviving spouse first. However, as per the Intestate Succession Act 1989 of Zambia, the property of deceased is to be divided among surviving spouse, parents of the deceased, their children, and other dependents. As a judge of the Supreme Court of Nepal, how do you give judgement on this case ?
