– Marital Property Division
New York is an equitable distribution state. Whose name appears on the title is not the important factor. Often issues arise concerning property that was acquired prior to the marriage. This property is considered separate; however, any increased value in the property itself may be considered a marital asset.

Child custody is based upon the best interests of the child or children. Usually the parent that is the full-time primary care giver will receive residential custody unless he/she is proven unfit. A person is not unfit if they have a boyfriend or girlfriend or committed adultery.
– Child Support
Child support is based upon the income of both parents. For one child the obligation is 17%, two is 25%, three is 28%, and four is 33%. The actual amount is figured based upon a proportion of the two parents’ incomes. One of the biggest issues in child support cases often involves determination of incomes.
– Modifications and Enforcements
The main area where we help clients with modifications is with their child support and child custody agreements. To change child support one party must show that there has been a change in circumstances that warrants a modification of the original order.
– Separation Agreements
A separation agreement is a detailed contract prepared by attorneys containing the respective rights and duties of the couple regarding issues such as child custody, visitation, support, property distribution, and all other matters related to the marital relationship.
