OVERVIEW

Ken Brennan is an accomplished trial lawyer with over 15 years of experience in courtrooms throughout the United States. Ken’s extensive experience on both sides of the courtroom have given him the broad range of practical knowledge and understanding required to address the complex technical and legal issues that arise in mass tort litigations. Ken is proud to have taken on some of the largest industries in the world – including the pharmaceutical, communications, auto, banking and insurance industries. Prior to concentrating on mass tort cases, Ken had a successful career representing individual consumers, small businesses, and multinational corporations.

PRACTICE AREAS:

ST. LOUIS RADIATION EXPOSURE LITIGATION
Ken Brennan has been appointed by United States District Court Judge Audrey Fleissig as Plaintiffs’ Lead Counsel in litigation involving over 150 plaintiffs alleging serious injury or death of a loved one as the result of exposure to radioactive waste dumped in North St. Louis County, Missouri. The consolidated litigation is pending in the United States District Court for the Eastern District of Missouri. A report published September 22, 2014 by the Missouri Department of Health and Senior Services showed statistically significantly higher than expected rates of leukemia, female breast cancer, colon cancer, prostate cancer, kidney cancers, and bladder cancer in contaminated neighborhoods. In addition, the report found the number of cases of brain and other nervous system cancer among children age 17 or younger was significantly higher than expected in parts of the contaminated area.

PHARMACEUTICAL LITIGATION
Ken Brennan is Co-Chair of the Briefing Committee in the Pradaxa (Dabigatran Etexilate) Products Liability Litigation pending in the United States District Court of the Southern District of Illinois. Over three thousand Plaintiffs allege they or a loved one developed serious bleeding as the result of use of a drug known as Pradaxa, which drug is said to lower the chance of blood clots forming in the body.

Ken Brennan has led legal briefing in the Actos (Piogliazone) Products Liability Litigation pending in Cook County, Illinois. Over three thousand Plaintiffs allege they or a loved one developed bladder cancer as the result of ingestion of a drug known as Actos, which drug is said to treat diabetes.

FALSE CLAIMS ACT LITIGATION
Ken Brennan represents the whistleblower in a multi-billion dollar False Claims Act action pending against an American pharmaceutical manufacturer. The action, pending in federal court, alleges the manufacturer misled the medical community and government payors about the benefits of its drug.

MARSEILLES FLOOD LITIGATION
Ken Brennan represents over 150 residents of Marseilles, Illinois whose homes were flooded in April 2013 after barges being towed by Ingram Barge Company crashed into a dam intersecting the town. The residents are seeking to recover for damages to their real estate and personal property. The litigation, known the Matter of the Complaint of Ingram Barge Company as Owner of the M/V Dale A. Heller, is pending in the United States District Court for the Northern District of Illinois.
