Understanding Criminal Defense, is really about understanding the issues in the case. Far too often attorneys I have seen attorneys who did not understand the issues . Sometimes these attorneys fail to address the issues, or reduce them to a footnote. This really deprives the defendant of a meaningful opportunity to be heard. Other times attorneys address the wrong issues, which can cast doubt of the credibility of the defendant. Finally some attorneys address too many issues, which dilutes the attention given to the important issues of the case by spending time on things that really don’t matter. Also at the trial level too many issues can take away from the credibility of the defendant.In a Criminal or Appellate Case counsel is necessary for a meaningful opportunity to be heard. The right to counsel applies at every adversarial stage in the criminal justice system, even in minor crimes.
