Smart Planning Before Marriage and Before Divorce: Facing Potential Problems Before They Happen
We encourage people to think clearly and responsibly both before marriage and when problems rear their ugly heads during a marriage. We recommend prenuptial agreements as a common-sense form of “insurance” against unexpected bends in the road ahead. But, spouses already married have the choice of problem solving by looking into a post nuptual agreement without ending the relationship as the solution.
However, once you feel certain that divorce is inevitable, you do well to take the time necessary to plan for a divorce that will protect your rights and assets to the greatest degree possible. If clients realize or decide that they are heading for divorce, we advise them of precautionary steps to take such as, document protection, business valuations, postnuptial agreements and documentation of parental involvement in preparation for negotiation of parenting plans. Being prepared is not a bad thing even while you’re working on saving your relationship.
