The question
Today I was told my position has been eliminated due to a restructure. I was given a Separation Agreement and Release Claim which states Terminated. I didn't sign this agreement because Just two weeks ago I filed a complaint against my boss because of his abusive behavior. This is the second time I've filed a complaint on him within a 5 year period. The first complaint was in my second year of employment when I notified HR my boss had a drinking problem to the point we were all kicked out of a networking dinner while attending the NRF in LA. I expressed my concerns then to HR, who set up a mediation class for our department. All was well until 2 weeks ago. I went back to HR for advice on how to get my Samsung tablet (personal item) back from my boss. I was instructed by HR to send a detailed email with all my attempt to my boss and see what happens. I was also told to forward all responses to the Director of HR as well, which I did. My bosses response to my detail email was "When I get to it, It will go out.
My tablet was sent out within 2days, however I've had my timesheet rejected as if I was stealing time. I sent detailed information regarding my time sheet. Then I was told, if I call out sick early during the week I cant make it up on a Saturday which still within the work week. I also told I cant no longer work from home anymore after doing so from time to time on Office days for 5 years now. There is not anything written in the company' policy and procedure on this. I've never been documented for any disciplinary related issues, however I have recieved a few corrective response email during my 5 year career. I wanted to know if is legal for them to do this.sounds like retaliation to me.
