Question

Unsure what to do about child custody

Asked 27 June 2013 · 1 answer

The question

I have a 19 month old daughter with my ex boyfriend. We lived together and then we got evicted from our apartment. We had nowhere to go and our relationship was not going good because he is an alcoholic. I had no choice but to leave the State of Indiana and moved to Wisconsin to live with family. We were trying to work on our relationship and he was ok about me being in Wisconsin but things got out of hand. Now he is telling me that he is taking me to court for kidnapping. He is listed as the father on her birth certificate but in the State of Indiana you have to get a paternity test within 72 hours otherwise the mother has sole custody and he didn't get the test done. My question is can the courts make me move back to Indiana since I have no job, income, or anywhere to live in the state? I have found work in Wisconsin but I will not start working until July 11. I'm not sure what my options are or what I should do.

i am not completely sure about the laws there but usually it comes down to the current state you I.D. or drivers license is from. if u have a Wisconsin ID then they can't make you move back because your state of residency Has been there the whole time.
