The question
I purchased a truck from a well-known dealership in Ohio. It came with tires on the vehicle that were slightly larger than the stock tires. After about a year i noticed some noise coming from underneath the truck driving and more prominent while turning. i realized my tires were rubbing on the suspension. i took the truck into the dealership thinking something was broken and needed fixed. They told me that the tires on the vehicle are too wide and rubbing causing the vehicle to be unsafe ( i do have this in writing from the service department). i also went and talked to the service technician who did the initial safety inspection when the dealership acquired the vehicle ( it was used) and in the original inspection it is noted that the tires rub. i asked for a copy and the person told me that he couldnt print it.
I went and asked the sales manager basically what they were going to do to fix it. its been over a month now and they refuse to call me back. I want the issue fixed, i need the vehicle to transport my son around and wouldnt like it very much if the tires blew and caused an accident with him in the vehicle. i purchased a 3 year extended warranty with them as well, not entirely sure that would matter or not as tires are not covered under the warranty. (obviously)
Do i have a case here? Are they not liable for selling me an "unsafe" vehicle (their words)?
Any help/knowledge/advice is appreciated!
