The question

Hi everybody just need advice. My wife was pregnant in about a

month ago she complained bout her side hurting. So I took her to the

city ER they did a pelvic ultrasound and blood work came back and

said everything is find its just cramp gave her cramp medicine. Then

scheduled an obyn 10 days later never seen a dr just a pa pretty

much didn't get any care at all. About a week later she complained

about the same thing so I took her to a diffrent ER did the same test

n came back as tubeluar pregency. They put her in emergency

surgery and removed the tube n the baby(17-20 weeks didn't make

it). Had ruptured her tube and her whole abdimal area was full of

blood. The surgeon recommend to seek legal counsel. Reason

cause the first ER should of found it which then they could of saved

the tube and he felt the care was unexceptable. An advice would

help thanks

I'd say this case is worth pursuing. There are three parts to a medical malpractice claim:

1) Injury

2) Negligence

3) Reasonable doctor standard

Your wife was injured and your child didn't make it. Since another surgeon believes that the first surgeon acted in a manner which was unacceptable, we can probably assume the third item was fulfilled. If you can find an attorney who can prove that the child would have made it and your wife wouldn't have been injured if it hadn't been for the first doctor's incompetence, then it would be a legal victory for you. Just be sure to find an attorney and file the case in court before the statute of limitations (lawsuit expiration date) passes. Good luck.
