Question

Summons to appear

Asked 8 November 2010 · 2 answers

The question

I just received a summons to appear in court, and the gentleman who served me informed me that I have 30 days to respond (if I want). As I was reviewing the documents, they are indicating that I have not made any attempt to make payments. However, when it finally got to the collection agency, I made about $1700 worth of payments ($1000 & then $100/month). When they asked to increase my payments to $180/month, and I told them "no" because I wasn't financially able to, they asked me to write a letter to them, which I did via fax and mail indicating that I wasn't able to make the increased payment of $180/month but was willing to make the original monthly payments of $100/month, and then do a review. Please help me as I want to know my options.

Hi. I'm not a lawyer, nor am I usually a fan of eHow,

but this link has some pretty good information:

All of those are good ideas, and, from what I

understand, collection agencies are usually willing to negotiate. Some money from you is better than no money

from you. I would continue trying to contact them,

make sure you get proof that they are authorized to

collect the debt, and keep records of all your written

communications with them.

Good luck!
