The question
I'm in Michigan.
I received a summons a few days ago for a capital one credit card I had in college.
The limit was 500 dollars, they are charging me 1400.
I had gone over the limit by a couple dollars and they started tacking on huge fees for OTL and late as I was struggling to pay. I kept making payments for a couple of months then stopped as the payments I was making weren't enough to offset the fees.
It was put on my credit report in Jan 05 and updated in Dec 09.
I'm trying to figure out a few things.
1. What should I write in my response to the summons?
2. Is the SOL in effect since I haven't been contacted by them since 2005, even though they had my address. (They had my original address, then the summons is written to the apartment I moved to after college when first returning to Michigan. Then it was delivered to my current address. All 3 addresses are listed on my credit report as well)
3. Should I contact the lawyer and work out a plan? On another website I was told the lawyer will not work out a payment plan.
I only make 550 a month since I was self employed and my major contract just canceled since they've fallen on hard times. So even in the case of going to court, the payment would be small I'm sure. I'd rather avoid a judgement.
I hope this is clear. Any help is appreciated.
