Question

Slip/fall at a club

The question

Hi I'm 16 years old. I got into a club using a friend's i'd for halloween (friend is 19+). Someone in the club smashed a bottle then there was liquor/broken glass on the ground but no one cleaned it up. A couple of minutes later I tripped on the broken glass because it was so dark inside and I couldnt see.I exitted the club and the bouncers called an ambulance. I had 22 stitches on my left leg. Will I be able to sue the club for 1.not being difficult enough in checking people's i'd and letting people who do not pass the legal age into the club, 2.not cleaning up the broken bottles/hazardous material immediately?

First of all, as a minor, you would most likely need a court-approved guardian to actually file the suit.

However, (though I'm not a lawyer) this looks to me like a premises liability case. I don't think the ID would have anything to do with it, as that did not contribute to your injury, but not cleaning up the glass could definitely be considered negligence on the part of the club, even though you were there illegally. That last part can have some bearing on whether or not you have a case, but premises liability laws usually protect trespassers and such as well as those that are on a property legally.

That is a forum post for a case similar to yours. There is not a wealth of information there, but there is some. The only way to know if you really have a case is to speak to a lawyer.

Best of luck

I agree with the above comment. I don't think that you will win the case since your a minor, But hiring a lawyer would be a good idea. I believe lying is one of the attorneys' skills. They are good at it, believe me.

I think even though even though you are minor, there is no harm in consulting a lawyer and getting your claim.Generally property owners whether private, public or commercial are required to maintain the premises well as well as ensuring the safety of others.Since you are injured,it is better to hire a slip and fall injury lawyer and seek legal aid. There are many personal injury law firms in Toronto like Campisi LLP Personal Injury Lawyers, who are experts in the field of law and help you to get maximum claims.

I would have to agree that it might not be a case that you win, but you could at least consult a lawyer. They should be able to discuss and advise you on what you might be able to do in this situation. It's kind of a unique situation. (removed)
