Question

rental contract, any unfair practise?

The question

Hi,

First, thank you all for your advise.

I am living in Singapore and I am asking on behalf of

my father. The story goes like this.

My father owns a company that moved into a new premise

in January 2011 after signing a contract for 2 years +

1 years (option to extend). He spent about S$30,000 on

renovations, furnishing and relocation services, etc.

Then in May 2011 he was asked to move out of the

premise. The premise was sub-let from the tenant and

the contract was signed between my father and the

tenant. The landlord had sold the property hence

affecting the tenant and my father.

The contract between the tenant and my father had

stated that 2 months notification period should be

given. And yes, my father was asked to leave before end

July 2011. However, only 6 months into the contract and

its terminated, moreover, the investments have now gone

to waste and not forgetting the trouble of relocating.

I know that 2 months notification has been served but I

want to ask all the legal professionals here if there

is a case to be fought and won here for unfair

practises? Maybe the contract between the tenant and

landlord expires in July 2011 and knowingly the tenant

signed the contract with my father. We never know since

we can't ask for the contract between the landlord and

tenant.

So, I would like to ask if there is a case to be fought

here and the chances of winning? We were thinking of

bringing it into the Small Claims Tribunal.

Thank you all!!!

cheers!
