The question
I was rammed in the face and driven into the door jamb of my vehicle while an employee of a carpet company was loading the carpet into my car. I had been laying the seat down and placing items from the seat under it when he decided without warning to load the carpet into the car. The roll hit my in the shoulder and glanced up to hit me in the face, then drove my head backwards into the top of the door jamb and finally into the side door jamb thereby causing pain in both shoulders, neck, and head. My face was cut from driving my glasses upward over my face. I dropped to the ground holding my face and my wife handed me some paper towels to put onto my face. I was groggy and don't remember a lot of things clearly until we got to the hospital. My wife said the employee apologized and went to get his manager. The manager stood there and told him to get paper towels. other than that they did nothing to help. she got me to my feet. she kept asking how I was. She asked if I wanted to go to the hospital. I finally made a decision to go and realized the carpeting was fully in the van. I told her we can't go to the hospital with that in the van. She told them to remove it.I went in and they took me in and treated me for a closed head injury. They did a cat scan and shoulder x-rays. I was given morphine for the pain and eventually sent home with instructions for a closed head wound concussion.
The owner of the carpet store called me and said that it was unfortunate and he would take care of giving us something more to my wife's liking. We unfortunately talked to him at his store trying to get some resolve to the incident.....I regret having done that!
I want to know if we can do anything. His reaction was one of laughter and feeling he was being bamboozled.
We had asked that he pay all medical costs and also install a carpeting of her choice. After feeling that he was dragging his heals and wasn't coming up with anything to satisfy us, His final comment about us adding things wrong with me made me mad and we left after getting a refund.
Do I still have any legal recourse.
