Question

Purchase and Sales agreement vs R35 form?

Asked 8 March 2013 · needs an answer

The question

I, the buyer, signed the Condo Purchase and Sales agreement with seller before inspections. After the inspection, we realized two of the heaters are under recall due to fire hazard. So I signed the R35 form with the request to repair/replace those items. Then the seller is saying we asked for too much so I revised R35 and indicated I will take the condo as is. However, he is backing out from the deal because he said now he knows the problems and he can't sell it and has to take it off from the market because of the "hazard" issues. Is it legal? Does the R35 form act as counteroffer and void the Sales agreement? He indicated earlier before the inspection saying that he got two other interested buyers. Please advise! Thanks!
