The question
Hi, I am not married to my 3 year old sons Father but we did sign an affidavit so his name would appear on the birth certificate. I have moved out but have allowed him access to his soon, meaning he has him on the weekends, etc. He is a good Dad but because he doesn't have any real legal rights to custody or visitation he is taking me to court to establish his rights. I understand why he would want to do this. The issue is he may go for primary custody but I don't know that until after Paternity is established by a judge, my fear is what will come after that. Right now I am a full time student and I will have my BOS degree by the end of this year and then go on to grad school The problem is the grad school is 2 hours away from him so he wants the court to say I have to live within 30 miles of him. And unfortunately both of us live in NW Missouri at this time but grad school is in Omaha, NE which is out of state. Keep in mind the plan was for me to go to Grad school all along, and it was ok for me to drive back and forth to school while I was living with him. But now it is not alright with him. So, I obviously need legal advice and representative but I am a full time student and unemployed. I do have income from my Father and state assistance, etc. but really little if any cash for an attorney. The other thing to consider is I live in an extremely small town community and my degree is in Medical Health Administration which pretty much means I have to work in a hospital and there isn't one within 30 miles except for an extremely small facility. This he also knew and it was perfectly ok for me to commute an hour back and forth to work if we were together. My question is can he or will a Judge rule that I have to live within 30 miles of him and that I must remain in Missouri? My closest family member leaves in Georgia. I don't have a problem with reasonable custody rights but I do have an issue about where I live. I feel like I am going to be taken hostage and all my school work will have been for nothing.
Thanks for any help or advice.
I am trying to locate free legal services or advice to at least point me in the right direction.
