Divorce laws generally check for residency, not citizenship, so you should be able to find a court willing to hear the case. File for a "fault" divorce, citing your husband's abusiveness as the fault. Under the "child's best interest standard," custody of the child will go to the parent most able to care for the child. Given your husband's behavior, meeting that standard should not be terribly difficult.
