The question

i live in lee county fl. this is my first offence and i need to know what this means exactly and what the possible charges are. my boyfriend and i were stoped at a gas pump at a circle k when a cop pulled up to the pump next to us. he waited a couple minutes then rounded the car to the drivers side and asked my boyfriend to get outa the car. he said he stoped us cause someone called and said they saw us smoking weed with our kids in the car. that part was not true but then pulled us all out and searched the car finding a couple pipes and a bong. was it legal for them to bother us in the first place?

Although automobiles are often granted exception from the advance warrant requirement, the officer does need a probable cause to search your car. “Probable cause” can be something so insubstantial as a hunch backed up by minimal evidence such as how you look (i.e. if your eyes appear red and glazed) or a scent that might be coming from the vehicle. It is probably in your best interest to consult a licensed attorney concerning the matter. In many cases, the lawyer will give you a free consultation.
