Question

Lawyer Unethical & Fraud

The question

My son was in a car accident at 12 yrs old. Money ($3,000) for lawsuit went into escrow until 18. Fast forward -son 18 now & cannot get money. Found out lawyer signed both my husband & my signature without our permission on son's insurance check, never put money in a bank account and the lawyer is in a nursing home with cancer. We had the insurance company send us a copy of the check to verify it wasn't our signatures.

We also gave same lawyer $300 to write our will (which he never did) and $1000 to make a 15 minute business phone call (Which should have only been $100). We have received no money to date for any of this mess. Our son is distraught as he was going to use this to buy a car so he can get a job & work.

When we called attorneys regarding all of this- all want a retainer of $600-1,000 down. We do not have this as we both lost our jobs due to medical issues & surgeries within the last 6 months. I cannot even collect unemployment until June 2013 due to medical release and am living off dwindling savings.

We were also told we can go to small claims court but it costs $120 to file each case which we also do not have. Our free legal services say they do not take cases like this. We feel since we did not cause any of this- we should not have to pay to remedy it.

We called the attorney handling this attorney's affairs and he stated there was nothing he could do.

Is there anything else we can do? The lawyer has not practiced in almost 2 years, his business is closed & his wife shredded all office paperwork info (wonder why??) but we do have the court case number and copy of our preliminary will as well as invoice for $1,000 for phone call.
