The question
My husband and I foster our 9 yr old granddaughter out of child protection in British Columbia. I got permission to move to Alberta with my husband and take my granddaughter there to live with us and her older sisters who I have court custody of. My husband lost his job so we informed the new social worker in Alberta that we wanted to either move to Ont or perhaps even Nova Scotia. We were told we could take the child. We left Alberta and then was told we had to return our granddaughter to BC. This child is an Aboriginal band member in Alberta. We immediately returned to Alberta and now refusing to go into BC. My question is.....if we stay out of BC can the ministry there issue a warrant to come and take my granddaughter (she has lived with me for almost 6 yrs)and if so how much time do they have to do this. If they took this child it would devaste her as we are the only family she has ever known. At the time she was apprehended in Vancouver we were asked to take her to be raised with her sisters. Can they split up siblings. Plus they now say I neglected the one sister and want to take her back to BC. I had taken the girls out of school with the plan to enrol them in school in eastern Canada but never got the chance before we had to come back to Alberta. What are our rights as Grandparents in this situation? We gone thru all the right chanells and now BC is pulling this off....what can we do to protect our granddaughter from further abuse thru the BC ministry? Can we start custody papers in Alberta or even another province or does it have to be done in BC?
