Question

False accusation of DUI

Asked 30 January 2015 · 1 answer

The question

A few months back, a truck hit the car which my brother and I was travelling. Both of us survived with minor injuries, but our car was totally wrecked. The truck was over speeding and didn't stop after the accident. We could not identify the truck or the driver. We were taken to the hospital by some cops who arrived there. After many months, both of us forgot about the incident and he got a call mentioning he has a court date regarding a DUI accident. I am sure both of us were completely sober during that incident and we weren’t even tested with a breathalyzer at that time. We have decided to consult lawyers Kostman & Pyzer Barristers from Toronto as per our friends’ suggestion. What are his chances to escape from this conviction?

If they don't have any proof that you were driving under the influence of drugs I don't think they can charge you with that. I would definitely talk to a lawyer, because I'm sure there is a way you can work through this. That's why they have lawyers, to represent people in court.
