Question

Ex Employee Wants Compenstation for Relocation

Asked 1 July 2012 · 1 answer

The question

I have an ex employee who quit. What happened was he was doing things his way and not the way the restaurant has been doing them. The hostess/server was trying to point him out to these things and he just brushed her off and ignored her. I had a meeting with both of them separately. When I talked with him he said that he was not told he was going to be babysat. I told him that things are done a certain why here, and that is how I want them done. He said it would not work out and that he will finish his last two tables and then be done. Now he wants compensation for his hotel and travel to Oregon from Alaska. I feel like I don't owe him anything as he took a risk coming here. Oregon is an at will employer and even if he was fired I would still not owe him anything. Am I right?

As long as the hotel and travel time was not for work, ie you didn't require him to travel, then you don't have to compensate him. Companies are under no longer for transportation payment if that transportation is not on behalf of the company.

For example, a company MUST pay an employee if the company wishes to send the employee from the office to China to represent the company at a meeting. The company DOESN'T have to pay for the employee's transportation to the office. You don't, for example, pay for the employee's gas if he drives or for the employee's bus fees if he takes public transportation.
