Question

Employee's Rights

Asked 1 February 2012 · 1 answer

The question

Is it legal to have your employee(s) go out to your second home (he let's

out of town saleman stay there when they are in town-thus he can say it is

part of his business even though it is located in a completely different

location than his place of business) and make his employees clean the

house and mow the lawn (he also goes there on weekends and some week

days with his family and stays). Can he fire my husband if he refuses to

go out there and play maid and gardener?

If your husband is an employee “at will,” then his employer can direct him to clean the house, mow the lawn or any other legal task he deems to give him to do. Your husband does not have legal leg to stand on by asserting, “You hired me to be an accountant.” It does not matter. His employer can task him to perform any job he chooses.

Of course, in an at-will relationship, your husband is free to refuse to do anything he finds demeaning and to walk out the door. However, the right to quit is largely the extent of his rights in this regard.
