Question

Dad in desperate need of legal Advice!

Asked 20 July 2011 · 2 answers

The question

I am recently divorced but had been seperated for over two years, i

have a four year old daughter in this marriage, i pay child support and i

do spend 3 to 4 days a week with my daughter a schedule agreed upon

by my ex wife and i, recently, i have moved on with my life and am in a

relationship with a great person who does work at the same company i

do, we do live together and are starting a family. Within these past

months my ex wife has done numerous things to make my life difficult

besides the constant calling that 90% of the time has nothing to do with

our daughter, she has even gone as far as come to my workplace to tell

my manager that my new partner and i are dating despite any company

policies that may prevent us from doing so, which has put my job in

jeopardy as well as my partners, all this done simply out of spite, when

doing this she took my daughter along with her, which i was appalled

by. she has also sent me threatening texts if i do not answer her calls

during work saying that she will take me to court if i do not respond on

time to her calls, when i have made it clear to her that i am working

and will always respond to a detailed messages when available, she has

sent me picture messages of herself for no clear reason except i would

imagine in hopes of making my partner upset, and has made

threatening comments in many voicemails.

In all my question is, is it possible to get a restraining order for these

incidents and will i have to get mandated visitation scheduling via

family law court prior to requesting a restraining order? and can i report

the above listed incident involving my child being taken to my

workplace to child or social services?

Hi,

Where are you writing from?

My first instinct is a civil stalking protection order; which may or may not interfere with your custody issue depending on your jurisdiction.
