Have you tried asking your lawyer or the court if they can provide you with copies of the complaint and the answers filed? If you can no longer afford your original lawyer, you may look into whether you qualify for a legal aid attorney to help you get this issue resolved.
The question
I filed Chapter 7 and got a discharge that included some old taxes (more than 3 years) a couple of consumer cards and a second m*rtg*g* that was from a private person and secured by our home which was sold at Trustee sale and we moved out. The second lien holder did not show up at the Bankruptcy hearing and almost 60 days later I got some papers from the BK Court and the lienholder asking for alot of info and they are claiming some type of fraud and are suing me for that money? My BK Lawyer was kind enough to answer the first basic interrogatories and now I'm on my own and jobless with this debt still looming. I lost alot of files in the move to a new place and can't find the original complaint or the answers my lawyer filed. 1) Where can I get these papers? 2.)What does the lienholder expect to gain, I thought the debt was extinguished with the sale of our home and the BK7? They have asked for a pre trial conference next week. What is this about?
