Question

Casual Sports injury

The question

We have two questions -

At a beach get-together,we were all playing volleyball,

mostly the guys. There was one lady in my team (whom I

met at the same event) who was positioned next to me.

During the game, when the ball landed in between us, I

hit the ball and accidentally bumped into her and she

fell to the ground. She complained of knee

pain.

The next day she sent a message asking me to share

medical costs as the injury could be a serious one and

her medical plan may not cover it.

Question 1 ) Am I responsible to pay her medical

charges? Can she take legal action against me ?

she has started harassing us by sending us emails

calling us names and saying things like we are devoid

of character etc. We haven't responded as we didn't

want to subject her to further misery.

We are quite perplexed with all the slandering and

harassment she has been subjecting us to.

Question 2 ) If this continues, can we take any kind of

legal action against her?

I know one of the things about personal injury law is

"assumption of risk." I think her deciding to play

volleyball with you precludes any liability you would

have. But, I am not a lawyer.

If she continues to email you, you might have a

harassment suit.

I would talk to a lawyer. I would agree with the previous comment, but it's better to be safe than sorry. I'm sure you could get a free consultation from an injury attorney, but I really think she assumed liability when she decided to play volleyball. (removed)
