Question

Can a person not go to an ordered dui school

Asked 10 December 2012 · 1 answer

The question

I was arrested for a dui in ventura california in sept 2008 . I first went to court in 2009 almost a year later. Between the time I got arrested and went to court I checked myself into a drug and alcohol rehabilitation hospital where I spent 31 days . After detoxing for about a week or so we started classes which we attended all day long every day. In court I tried to bring this up but to no avail with a public defender

I need to know if that stay in the hospital and the fact that i dont drive, and am not going to drive give me the right to not have to take the dui class imposed by the court especially since i can,t afford it anyway.

If the driving class was ordered by the court, you must take the course regardless of what you think is fair. If you disobey the court for any reason, that is contempt of court, which is a crime. If you don't have the money, I suggest you ask the judge or the administration behind the driving class for a waiver. I highly doubt money can be a legitimate excuse for ignoring a judge's order.

Best of luck.
