The question
I am getting ready to file for BK and I also have a work related injury that has taken 5 months already to treat. I don't see an end in sight with my treatments. I live in Mississippi and was injured in Mississippi. This has caused a major financial burden on me and that is partially why I started to crash and burn! My question is when I file for BK and if I get a settlement with worker's comp, will the court be able to take any settlement that I might receive?
Also, what does this mean?
MISSISSIPPI CODE
TITLE 71. LABOR AND INDUSTRY
CHAPTER 3. WORKERS' COMPENSATION GENERAL PROVISIONS
Sec. 71-3-43. Assignment invalid; exemption from creditors
No assignment, release, or commutation of compensation or benefits due or payable under this chapter, except as provided by this chapter, shall be valid; and such compensation and benefits shall be exempt from all claims of creditors and from levy, execution, and attachment or other remedy for recovery or collection of a debt, which exemption may be waived.
Thanks for your help.
