You should talk with your bankruptcy attorney who helped you file a Chapter 13. You can modify your existing Chapter 13 by filing a motion with the court. The question is, why did you file a Chapter 13 instead of a Chapter 7? If your income was too high because of your combined income, you may qualify for a Chapter 7 once you separate. If you filed a Chapter 13 to keep a house, then you may want to just let the house go. If you want to get divorced, staying married because of your Chapter 13 doesn't make a lot of sense. Your bankruptcy attorney is likely willing to give you a free consultation about options now that your circumstances have changed.
The question
i am considering divorce. i want to protect my current wife financially from my ex-wife. problem is my current wife and i had to file chapter 13 little over 3 years ago. i want to get divorce but continue living together until chapter 13 is payed off, which is in about 1 and 1/2 years. neither of us can afford to live on our own right now because of bankruptcy. is divorce possible without having chapter 13 office making us sell house and liquidate to pay off debt?
