Asked 31 August 2010 · 1 answer

The question

Hi I have been waiting for unemployment benefits but I haven't received any,my employer is fighting it. I have a phone interview with Unemployment services in Sept.My employer fired me for a "bad attitude". I was always on time, employed for 5 years, never received any written or verbal warnings for dismissal, no exit paperwork. How can I fight this and or what should I say to unemployment? I'm located in NJ

Thank you.

I'm not a lawyer, and I know this is coming a little

late, but New Jersey is an "at-will" employment state,

which means that you can be fired for any reason (other

than illegal discrimination), just as you can quit for

any reason, unless otherwise stipulated in a contract

you've entered into with your employer.

According to this, you may be considered to have

committed "simple" misconduct which could disqualify

you from unemployment for a few weeks. However, they

may not consider it misconduct at all, and there is a

chance that you could still receive them.

I hope you did! Remember: your employer cannot lie.

It is illegal.
