Assault would be the swing her took at you, and battery
would be hitting you in face.
You can sue for assault even if there is no criminal
conviction, but you have to wonder if it would be worth
it. Would the amount you'd pay a lawyer be worth it
compared to if you won the lawsuit? How much money
does your brother have?
A lawyer could also draft a letter to your brother
asking him for a certain amount of money to cover your
medical expenses and whatever else. This could avoid a
lengthy lawsuit and expensive legal fees.
You also want to consider whether or not you can prove
it. I would speak to a personal injury attorney about
all this. He or she is likely to give you a free
consultation and tell you if its worth it to sue or
not. If it isn't, you will know, because lawyers
generally don't take cases that won't be profitable.
What's good for you is good for them.
Hope all that helps!
