I'm not familiar with the specific laws in VA but in my opinion, I don't think that such a minor error would be grounds for dismissal of the ticket. That said, you could definitely take your chances and try to fight it, especially since your job is on the line. However, the expense of traveling back to VA to fight it may outweigh the the benefit. You could try calling a lawyer in the Arlington area who handles traffic offenses like speeding. Find one that offers a free consultation, explain your situation, and see if he/she thinks you have a reasonable shot at getting the ticket dismissed. That being said, I'm not a legal expert but I hope everything works out for you.
The question
I received a speeding ticket on Lee Highway last month,41mph in a 30. I live in Pennsylvania and I am not sure how points work from state to state. I contacted someone who said Va. has a minimum point system of 3 points. I cannot afford points on my license since I drive for my job,my question to you is since I was in my company van clearly marked with logos and company name, the issuing officer checked a box on the ticket "Commercial vehicle " he checked NO. Would I have a not guilty due to technicality since it was clearly a commercial vehicle? Any assistance would be greatly appreciated.
