Question

Wrongfully accuse of domestic violence charges

Asked 2 April 2011 · 1 answer

The question

Before me and my husband got together he had a child with another lady, which he has no problem of taking care of him but after seperating with this woman. She felt the need to accuse him of Battery Against a Household Member (BHHM) 30-3-15, kidnapping and a few others that I cant think of the legal terms for.

Well she did this all out of revenge since he left her due to not wanting to deal with her physical and mental abuse.

She does have prior history of doing this to men she dates but the court would not see that. Also while these aligations were going on and going through court she made up stories which were proven to be false by private investigators, probation officers and lawyers; still didnt go in favor of my husband.

myself and another ex of my husband were harrassed by friends of her to try and get us to react to her; again still didnt go in favor of my husband

long story short......my husband was sentenced yesterday for 18mths of jail time? could we appeal this since one of the DA's we had only had a week to investigate and the other was fairly new?

NOTE: we're in ALBUQUERQUE, NEW MEXICO and dont have much money but willing to find funds to pay a great lawyer

A lawyer can tell you how to appeal and on what grounds.

If what you're saying is true, having competent legal

counsel on your side could get your husband out of there.

Most lawyers give free initial consultations. You can

even fill out one of the forms on this site. But its

important that you speak with an attorney and quickly.

Hope that helps!
