Question

What can I do?

Asked 5 November 2012 · 1 answer

The question

I currently work at a bank. My started position was operator. Lately, when an position that pay more open,

I applied and now working there. We are not only get pay on base income but,

also get incentive for productivity. At this new position people usually get a lot more

incentive than the one when I started(5-8 times). Anywhere, even the first one or the currently,

I'm always the top perform. But, whenever my company hire the new one, they kicked me out back

to the first one(where I get less incentive and very hard job compare to the current one). They did

that to me again and again(Three times already). I feel very bad about that. I can only got back my position because those

new people got fired or quit the Job.

Last month, one of employee from another shift messed up with the machine, but manager

written me up and blamed it on me. Two days ago, they again written me up for "cheating" even they don't have any evidence

about that, and sure I'm not.

I'm so stressful since working there but don't know what to do since HR in my company always protect for their management.

Recently, they have promote two new leads. These two peoples don't show anything to be a hard workers. One is kind of lazy and the other

is new one and don't show any evidence that to be a good one, and both don't have any experiences on lead or management.

Most of us work there very hard and have a lot of experiences but we never get any promotion, but those new two. For me(and some of my coworker),

they get their position because they are white.

Should I call lawyer to protect me on this case? I'm so stressful but don't know what to do. I can not leave my job know because some people

need me take care of. I'm trying to find a new job but can not get it now. Please give me an advice.

Thank you very much!

First, you need to send a complaint to the Equal Employment Opportunity Commission (EEOC). The EEOC is a federal agency which will decide whether you have a case that has a chance in court. If you obtain a right to sue letter, you may proceed to court.

If the EEOC gives you the go ahead, you can bring evidence (statistics, testimony, etc.) that your employer is discriminating on the basis of race for promotions.
