The question

My son was recently arrested for aggravated assault. He was walking by a store and the woman came out and asked him if he had entered the store and he said "no". And she started yelling and telling him keep on walking "wetback". there were some construcitn workers nearby and heard this woman screaming and they rushed over hit him in the head with something and he was knocked unconscience, when he fell to the ground (unaware) he landed on one of the men's hand and it supposedly broke. when he came to, he was bound at the feet unable to move. He was held until authorities arrived and he was taken to jail, where he now sits awaring trial. He is being represented by a publi defender. He wants to fight this case becasue he says he is totally innocent. we can not afford the bail amount therefore he remains in jail. Int he meantime he lost his job and he was attending school and was withdrawn. the authorities took pictures of his injuries. we want to know if it is legal to bind someone. He was tied at the feet. and they beat him up while knocked out. Please advice..

respectfully submitted

The public defender assigned to your son, most probably, knows that it isn't legal to bind someone, much less hit him and knock him out. I am not a lawyer handling felonies but I sympathized with you and your family if what you say is true. If your means permit you, you may opt to look for a private counsel. He may have more time and focus than the public defender.
