Question

The Divorce Mind game...

Asked 15 October 2012 · 1 answer

The question

My husband has filed for a divorce at my request. We have been separated for about a year. He currently resides in Nevada and I am in a different state. The divorce pace of Nevada is much swifter. So he filed in July. I didn't receive my certified signed receipt copy until a recent mailing in September. I responded with no objections and sent back my answer certified signed receipt. He has failed to retrieve this letter from the Post office. Now I am not entirely sure if the original signed receipt for the summons was turned in to the court. Despite the divorce proceedings being public record, the clerks have failed to provide me with any information. I feel stuck between a rock and a hard place. Would it be effective to have him personally served and by pass any further games? Would the divorce proceed, with or without the summons signed receipt delivery slip (again, not sure that he turned it into the court. I do believe it is a game to try to get my attention and play poker with me). Any help would be great. I thank you in advance.

Yes. You should give your husband notice since the right to notice is in the 14th amendment. Even if you clear this legal hurdle, it is always possible that your husband could have the eventual judgment voided for failure to properly serve him.
