Question

Settlement Offered

Asked 23 November 2010 · 2 answers

The question

I was denied employment in NYS due to a conviction record. I filed a complaint with the Human Rights Division. The respondent (a major company) wants to offer early settlement. They do not want a hearing or trial. What is a reasonable monetary request I should be asking for. The position was a salary plus commission for a total compensation package of around $90,000 per year.

I'm not a legal expert but this:

(removed)

shows settlements recorded by the commission on human

rights for cases over the last few years. Many of them

seem similar to yours, and the settlements are

generally in the low- to mid-1,000s. It looks like

you're asking for quite a bit more.

However, there might be something you can't see. It

could even be worth more, but I think only a lawyer

would be able to tell. Might be worth a consultation.

Thanks for the info. I told the rep from the Division to tell them I would settle for $15K. I was just showing what the income from the job was in my original post. If they don't settle I will let it play out because I am sure based on the facts the Division would fine them at least that just as a fine. Thanks Again.
