Question

No Injury Auto Accident

The question

My wife was rear ended by an Acitive Duty Navy Officer about 6 weeks ago. State is Virginia, their insurance is USAA, ours Geico. My wifes car was then pushed into the car in front. The driver didn't want to call the police, but my wife did. Police came out, no report (or ticket) as the officer felt the damage was under $1500. He filled out an info sheet listing his estimate of the damages at $250.

We called our insurance to report it and also contacted the drivers insurance, USAA. The only thing so far USAA has authorized is getting a repair estimate from thier shop and the estimate is $3000.00.

My wife was sore a couple of days, but is over it, no big deal. She only wants her car fixed and a rental while it's in the shop, that's it, fair & square.

Today, she contacted USAA and they told her their driver is refusing to call them back after repeated messages and there is nothing they can do until they get her statement. They have the statement from the person in front of my wifes car she got pushed into.

Other than just having Geico fix it and go after USAA, is there any type of legal relief? Since their are no injuries, are attorneys interested without an up front payment we may never see again?

Any advice would be appreciated.

I'm not a lawyer or anything, but since the at-fault driver is not cooperating, you may want to get a police report of the accident.

Other than contacting a car accident lawyer in your area, it doesn't seem there's really much else you can do other than wait. If you do retain a lawyer, I think you should make sure you send a letter to the at-fault driver telling them you've done so. If many cases, at-fault drivers tend to cooperate once a lawyer gets involved.

Another option could be to go to your state's DMV website and fill out and file an SR-1 form (Proof of Financial Responsibility). Once an SR-1 form has been processed, the at-fault driver will have to contact the DMV and his insurance company. I'm not positive on this, but if there are no injuries from the accident your case could end up in small claims court.

I'm not an attorney and you need to remember auto accident insurance statutes are different in every state, but hopefully this link can provide you with some clarity:

Hiring a qualified lawyer can really help you to solve your case. Expungement refers to the process of sealing arrest and conviction records. Virtually every state has enacted laws that allow people to expunge arrests and convictions from their records.

Do not just take a personal injury lawyer's word for it when it comes to their record. Talk to some of their clients, and ask the lawyer for a written record of their practice. This will give you a good idea as to how often this lawyer wins and what type of money he is used to dealing with.
