I suggest you find a good lawyer, since your case has procedure problems all over it.

First, you need to give notice to your husband that you are seeking a divorce. Although the law in the United States requires that the notice be delivered to the other parties usual place of residence, I'm not too sure about the laws in other countries. You will need a good lawyer to tell you about that.

Second, the court you take your husband to must have jurisdiction (power) over your case. Are you, your husband, and your children American citizens? If not, could a court in Afghanistan hear the case? What about a court in whatever country your husband is in? Again, you need a good lawyer to help you resolve this issue. Best of luck.
