Question

listing wrong about hardwood floor under carpet

Asked 2 March 2010 · 1 answer

The question

The listing clearly stated hardwood floors under all carpets. We checked out one of the bedrooms before closing and it was OK but not all the carpeted rooms. 6 months after close, we decided to remove living room carpet and guess what...no hardwood. Can we pursue a civil claim against the realtor for the difference in cost between a new carpet and a new hardwood floor which will match the rest of the house? The rest of the hardwood floors are a special type which is rather pricey. Or maybe a claim against the previous owner? ALthough the realtor stated they were present, shouldn't the homeowner have done due diligence on the listing?

I think you might be able to file a claim, but it might be good to talk to a real estate lawyer first. There might be some other options you can look at first, which might be better. I'm sorry that it's been so troublesome for you, hopefully this can all work out. I really would suggest talking to a real estate lawyer before you do anything else. (removed)
