Question

In what state should I file a case ?

Asked 7 June 2011 · 1 answer

The question

My Client is in Atlanta GA.

He is not making payments for past invoices (Jan-Jun A total of

100,000 USD). I am a NY based Business.

My Client's contract that has payment terms (Which is 5 Days after his

client pays him. I have confirmation that his client paid him for all

services so far) says "Applicable Law. This Agreement will be

governed by, and construed and interpreted in accordance with, the

laws of the State of Georgia."

Can I file a case in NY because I am a NY based company or should I file

a case in GA court?

I am not a licensed attorney in New York/Georgia and

nothing in this message is legal advice nor is it

intended to be. You should contact a New York attorney

regarding your situation.

What that said, the short answer is that you may file a

lawsuit in either state. However there are other

concerns at hand. For example, if the matter does

enter litigation, there may be strategic advantages in

one state over the other (ie: state laws, location of

witnesses, etc). Therefore, I strongly advise you to

contact a civil litigation attorney in your state to

discuss the matter.

Best of luck,

Eric
