Question

denied medication

Asked 30 January 2013 · 1 answer

The question

Have had ongoing migraines and other symptoms for several months now, have been seeing a primary physician, and he was prescribing me endocet in 60 dose amounts. Now the clinic wont renew my prescription, because of the area I moved to saying its my demographic. Can they do that? They havent cured my migraines yet and OTC painkillers just werent enough.

I'm obviuously not a qualified attorney, but it's a possibility your clinic can legally refuse to renew your Endocet prescription because you moved to an area known for problems with the sale and abuse of prescription pain medications (opiods). The feds have been cracking down on areas known for "pill mills" that over-prescribe and even illegally sell pain meds. For example, this link ( (removed) ) illustrates one method authorities in Florida are using to fight the epidemic. An unfortunate side effect of the war on illegal prescription drugs, however, is that some people who are in legitimate pain and need medication will be unable to have it prescribed to them.

It's smart to speak with a lawyer in your area and ask about the legality of being denied medication you need based on the demographics of where you live. Each state's laws on the subject are different. Good luck.
