Question

Cousin transfers title to Aunt's home to himself

Asked 15 October 2010 · 1 answer

The question

I have no family other than my Aunt. I just found out that my cousin obtained a power of atty over my aunt, when she has lost most of her capacity to understand what she signed. Then I found out that the title to her home was transferred to the cousin for his own purpose. He claims it was so that a nursing home would not take her home.

I hired an attorney, then my cousin hired an attorney of his own, and was forced to transfer the grant deed back to my Aunt's name. He has done so, but my attorney cannot find that it was recorded. Is there a time frame in which it must be recorded? Can my cousin change his mind? There is no will or trust, but I would hate to see what would happen if he does not get the grant deed recorded.

Any advice?

From what I can tell (I'm not a lawyer), you can record

the deed yourself, or have someone else do it. Contact

the local courthouse and see what needs to be done:

whether your aunt needs to be present or if someone can

go in her stead.

I just looked on here:
