According to the California NORML website, “As of January 1, 2011, possession of one ounce (28.5 grams) or less of marijuana is an infraction punishable by a maximum of $100 fine (plus fees) with no criminal record.” As long as you were not intoxicated while you were driving (which it does not sound like you were), the worst penalty you can receive for marijuana possession in Cali is a fine of $100. It’s always a good idea to consult an attorney to discuss how you should plead though.
The question
I live in California and 2 weeks ago I was pulled over for speeding (not cited for it) but I was cited for less than an ounce of marijuana (3.5g to be exact) I did not have my medical marijuana recomondation at the time, but got it a week after the citation. So my question is, when I go to court, how should I plea, and should I mention the fact I have my medical marijuana card from my doctor, or not? This is my first time ever being in any type of trouble with the law. Any help would be greatly appreciated. Thanks!
