This sounds like an unusual case. Are you sure the car was in park before you got out of the car? Did you have your parking brake on? I'm not sure, but it's possible that failure to put the car in park or failure to use the parking brake could be considered careless driving. If you are determined to fight the ticket, I would suggest speaking to a lawyer who handles traffic ticket cases and see if the lawyer thinks you have a chance of winning. It may also help your case that you have a witness to support your story.
The question
I got a careless driving ticket, but I wasn't in the car! My car popped into reverse while I was outside the car and knocked down a mailbox. The cop didn't believe me that I wasn't in the car because he said they have safety mechanisms. My neighbor witnessed the whole thing and said I wasn't in the car, as she saw me chasing the car. I go to court next week. Do you think I can win?
