In order to bring a claim for malpractice, you need to be able to show injury, negligence, and that the negligence caused the injury. You should speak with other women who have recently had C-sections to see if the pain they are going through is similar to yours to make sure that the injuries you are experiencing are less than standard after this type of operation. Negligence and causation will be harder to prove.
The typical way to show negligence is by comparing what your physician did to the conduct of other physicians in that same situation. For example, did your physician use the correct amount of medication? Did your physician even have to perform a C-section?
If you can show that what the physician did was not what a reasonable physician would have done, then you to prove that the physician's error resulted in the problems you are correctly experiencing.
