In unfortunate cases where incarceration is ordered, we are adept at working with the court and state attorneys to structure sentencing requirements around the health and welfare concerns of our clients.
To help prepare for our clients’ cases, we have our private investigator interview potential witnesses and record their statements. We then use that information to form cross-examination and direct examination questions. If the witnesses say something different from their initial interview, we use the recordings to impeach them. We take full advantage of preliminary hearings to build a record. In other words, we cross-examine hostile witnesses at prelims so that their testimony is under oath so that they cannot change their story later on. Many times, we have been able to catch witnesses lying under oath at the preliminary hearing so that we can show they are not credible at trial.
